Negotiation Strategies Essay

Throughout the world, most countries have chosen to allow employers to dismiss employees only for just cause. The employer must present evidence or an argument that supports the notion to dismiss the employee. This method ensures that an individual is fired for good cause and prevents misunderstanding between the employer and employee. In the United States, the basis for termination of employees differs greatly. Employment-at-will is a term that means that an employer can terminate an employee at any time for any reason or for no reason without occurring legal liability (Stone, 2007). In the same respect, an employee is free to leave a job at any time for any or no reason with no adverse legal consequences. The purpose of this paper is to present scenarios that question the legality and exceptions of the employment-at-will doctrine and to give opinions on how to handle the scenarios. Negotiation strategies come from understanding the negotiation process and knowing how others consider and view it. The person negotiating should watch out for tricks another may use to convince he/she that they are wrong. The best and most valued negotiation strategy is to first identify the â€Å"what’s wrong† problem and what the competition is requiring. For example, Tameka is a new employee at an accounting firm that is unable to learn and apply basic computer applications. The computer applications are mandatory to the job responsibilities outlined for Tameka. She makes remarks implying that she is not appreciated and is a good worker, regardless of her ability to complete the tasks. Skills, competence, and ability to perform a job are a necessity in the workplace. In an accounting firm, a simple mistake can be detrimental. It appears that Tameka exaggerated her abilities and was intentionally misleading upon being hired which exhibits a lack of veracity. This observation alone provides management with just cause to dismiss her. However, there are steps that can be taken to properly assess this situation. This is where the negotiation process kicks in. The first step would be to train the employee. The reading indicates that Tameka has been given months of training, and she is still incapable of completing tasks. I would be sure to document the training sessions that were offered to Tameka, and I would record her performance in each one. I would make Tameka sign off and clarify that she attended each training session to prevent verbal implications. After Tameka’s failed attempt at training, I would compose a formal document outlining my concerns about her performance. This document would serve as a warning for termination. I would give her two weeks to show improvement, even though she has already had the opportunity to do so. This document would reduce any risk or liability to the company. If two weeks have passed and Tameka has shown no improvement, she will be terminated. Tameka may try to combat by using the â€Å"implied covenant of good faith and fair dealing† exception to the employment-at-will doctrine. This exception usually involves a discharged employee who contends that the employer has indicated in various ways that the employee has job security and will be treated fairly (Smith, 1985). When Tameka indicated that she was a good worker who felt she was not appreciated, it set the grounds for accusations of good faith and fair dealing. Tameka would not be successful if she filed charges because she was not honest about her credentials. She led the employer to believe she was capable of completing tasks that she was treated fairly throughout the process by being given multiple chances to improve her performance. In scenario two, Tameka is frequently late to work and has major behavioral issues. As the supervisor, I tried to address the issues but Tameka retaliated that she is aware of the exceptions to the employment-at-will doctrine and wrongful discharge in violation of public policy. The first step to rectifying this situation is to review the employee code of conduct handbook. I would check to make sure the company’s late policy and zero tolerance for inappropriate behavior are duly noted. Then, I would give a copy to Tameka to read and sign clarifying that she has read and agrees to the rules. After she has signed the rules and regulations, I would have a talk with her to address the issues and warn her of the seriousness of the offense. If the behavior continues, I will compose a formal document to serve as a final warning to Tameka before termination occurs. If the behavior continues, she will be terminated. Her termination would be based on her unwillingness to follow company rules, not respecting and treating her co-workers fairly, and not meeting performance expectations. Tameka may try to retaliate by claiming wrongful discharge in violation of public policy, which is another exception to the employment-at-will doctrine. Cases, using the public policy exception, protects employees who are discharged for fulfilling a public obligation, protects workers who are fired for exercising statutory rights, employees who are dismissed for refusing to participate in illegal or unethical activity, and to protect individuals who are discharged for blowing the whistle on the activities of their employers or co-workers (Callahan, 1991). In Tameka’s case, wrongful discharge would not apply. She failed to adhere to company policies, and even after corrective coaching she still made no attempts at improvement. Tameka’s signature on the rules and regulations sheet, the one-on-one session, and time given for improvement would reduce any liability on my part. The documentation I have for the situation would stand. In scenario three, Tameka takes off from work without management consent to observe a religious holiday. Coincidentally, the day occurs during a busy period for the company. Prior to the holiday, management stated that no one could take off without consent. Tameka encourages her co-workers to organize and form a labor union for protection. In this scenario, it would be unlawful to dismiss Tameka. However, I would compose a formal document to Tameka expressing the importance of calling in and letting management know if she will not be able to make work. I would reassure her that the company does not discriminate against employees regardless of their religious affiliation. I would send out a correspondence to all employees restating what I told Tameka to be sure everyone has an understanding of our non-discriminatory policy, and our appreciation toward calling in to work to make sure all shifts will be covered. Tameka’s protection lies in the Civil Rights Act of 1964. Title VII of the Civil Rights Act of 1964 specifically forbids discrimination on the basis of religion for employment purposes, except when the employer is a religious organization , or when religion is a bona fide occupational qualification (Adams, 2001). Tameka’s observance of the religious holiday is covered under this act. I could do nothing if Tameka and her co-workers wanted to form a labor union. The National Labors Relations Act (NLRA) protects the rights of employees to form or join a union, and prohibits employers from interfering, restraining, or coercing employees in the exercise of their rights to organize (Hollo, 2008). In the last scenario, Tameka’s direct supervisor continuously asks her out on dates. She was informed during orientation of the company policy that prevents employees from dating their supervisor. Despite this, Tameka and her supervisor enter into a consensual relationship. The reading refers to the relationship as â€Å"consensual† which means both parties agreed to the relationship. Tameka’s job was not threatened in any way if she did not choose to have the relationship with the supervisor. Equally, the supervisor was not coerced into the relationship in any way. I would interview both employees to get a detailed account of the relationship and have them both sign and date it. This would reduce any liability and risk on my part. Both parties knew it was wrong, but they still continued the relationship. If both parties agree to end the relationship, I would have them sign a document stating that the relationship will be ended or termination will apply. Tameka and the supervisor could argue under the exception of implied covenant of good faith and fair dealing. They may feel it is unfair that they have to end their relationship or that they were not knowledgeable. However, both parties had full knowledge of company policy. Supervisors generally have more job security. It is likely the supervisor could argue his termination would counteract the company’s implication of good faith in him. Regardless, all arguments made by Tameka and the supervisor would fail to prove a legit point. The company is showing enough good faith, just by allowing them the opportunity to rectify the situation. In conclusion, exceptions to the employment-at-will doctrine can be controversial. It is important to always document incidents and situations, in case it is needed for protection in a lawsuit. Both employees and employers have allegiance to each other, and when one or both parties violates that allegiance, termination is often the result. Prevention of termination and other work related issues is directly related to the employee and employers understanding of company rules and regulations. The strategic factor is based on identifying an organization’s key stakeholders. It is called the strategic factor because the strategies and measures developed via it are based on the factors relevant to an organization’s key stakeholder’s.

Pros and Cons of FDRs Brainchild: The New Deal

The New Deal & FDR The implementation of the New Deal was a necessary, yet highly criticized, and controversial time in our nation's history. Its creation, by President Franklin Delano Roosevelt, helped to resurrect a crumbling economy and put Americans back to work. However, like most things in life, there are always two sides to every story. This paper will explore both the pros and cons of FDR's, brainchild, the New Deal. In addition, it will argue that regardless of a positive or negative public opinion, there is no negating the fact that the New Deal was a pivotal movement and progressive step forward in our nation's history.The presidential election of 1932 favored Democrat Franklin Delano Roosevelt over current president, Herbert Hoover, by a staggering 7 million popular votes. It seemed that the citizens of the great United States of America had spoken; they were ready for change. FDR believed that the solution to the economic crisis could be achievable, but only by having a more involved government. He held firm that giving the federal government more control in the nation's economy could begin to undo the damage caused by the Great Depression.Roosevelt promised a New Deal to the American public; a conglomerate of government programs aimed at revitalizing the economy by restoring our banking system and creating new jobs. Almost immediately following his inauguration, FDR closed down all the banks in the country for four days and called an emergency hearing with Congress. The Emergency Banking Act was created, which â€Å"gave the government the opportunity to inspect the health of all banks† (Franklin D. Roosevelt – American Heritage Center, Inc. ).The Federal Deposit Insurance Corporation, or FDIC, was also created to insure consumer and business deposits up to $5,000 (a far cry from today's $250,000). FDR, urged Americans to trust in banks again. Ultimately, he wanted to see people embrace the concept of consumer capitalism. In short, h e called for every citizen to march to their local bank, and show good faith by depositing all their life savings. Once the banks had the support of the public, they could in turn, begin making loans again. These loans funded the creation of new businesses and the restoration of the old ones.Businesses were then able to hire or re-hire workers, and in many cases, increase wages as well. With higher wages comes greater spending power. The goal was to see the population of the U. S. become a nation of consumers once again. By pouring their money and capital back into the economy, U. S. citizens could play a role in getting American back on her feet. A provision of the New Deal, called the Civil Works Administration, or CWA, was created to â€Å"give the unemployed jobs building or repairing roads, parks and airports and providing psychological and physical boosts to its 4 million workers† (Franklin D.Roosevelt -American Heritage Center, Inc. ). A similar program, called the Civ ilian Conservation Corps, or CCC, was an environmental program that helped 2. 5 million unmarried men return to work maintaining beaches and forests and also gave jobs to 8500 women. Other successful programs that are relevant to today's modern society are programs such as Social Security, the National Labor Relations Act, or Wagner Act; which protects workers' rights to assemble, or unionize.In addition, the Fair Labor Standards Act of 1938 was passed, which abolished child labor and set the minimum wage. While the New Deal had a great many triumphs, some may argue that though the tragedies were few, they had a far more devastating impact on the economy. Roosevelt implemented such controversial programs as the National Industrial Recovery Act, or NIRA, which was created to bolster the decreasing price of industrial goods. Unfortunately, there were some unforeseen and catastrophic consequences. When higher wages went into effect, prices rose too. Thus, consumers stopped buying. The continuous cycle of overproduction and underconsumption put businesses back into a slump† the law was later ruled unconstitutional (Norton et al, 698). Another controversial provision of the New Deal was the Agriculture Adjustment Administration, or AAA, which attempted to raise farm prices. It used special tax funds to pay farmers to refrain from raising certain crops or breed certain types of animals.They figured the lower production would help to increase prices of other agricultural products. All it did was anger the general populous, who thought this was atrocious. People were starving and homeless and the federal government was essentially wasting food! This program was ruled unconstitutional, shortly after it was proved a failure. Though Roosevelt had many ups and downs during his 12+ years as President, he successfully began the process of getting the nation back on its feet.He created the New Deal, though it was not the end all be all of the economic crisis, it contri buted to the demise of the Great Depression in a broader sense. It restored the public faith in banks and got many, many Americans back to work. Dual Route Model in Adult Reading Introduction Dual route model is the study that defines the changes in the mode of interpreting printed words to sound. Therefore dual route model is associated with the study of reading and spelling and the various assumptions that arise out of the investigation. These assumptions highlight the fact that the processing of the written language is always accomplished by two separate methods called the lexical and non-lexical routes. These two methods are interactive in nature. Reading and spelling in the lexical method always depends on the creation of word specific orthographic and phonological memory representation. All the current models of word recognition are based on either the dual route models or connectionist theories. The way a word recognition model accounts for different types of reading behaviours, is the word of success of every model. The dual model theory has withstood most of the tests associated with reading behaviours. However some psychologists do not agree with this theory, instead they suggest a combination of dual as well as other models for deriving positive results in the field of reading behaviours. A number of psychologists have researched in this field and published their results. Prominent among them is the study reports of Coltheart and Bates, who have demonstrated that an equation derived from dual-route theory accurately predicts reading performance in young normal readers with reading impairment due to developmental dyslexia or stroke. Studies conducted by John Marshal also have much significance. Marshal concentrated on the fact that the method of skilled reading can be used, particularly the dual route model, for interpreting acquired dyslexia as well as developmental dyslexia. The basic concept of the dual model explains that non words and irregular words are two independent routes that lead from the written word to the noise. There is also the direct access route which is also known as the lexical route. This route deals with the pronunciation of irregular words. In this method reading is always continued through the lexicon for the purpose of pronouncing words correctly. Then there is the Grapheme phoneme conversion route which is also called the sub lexical route. In this route reading is continued without accessing the lexicon. All regular words and irregular words should be read from the lexicon, this is the suggestion given by the dual route model. A strong judgement in this regard is that the steadiness of the word always effects the periods it takes to name it. Moreover there is also a relation with its rate of recurrence. Low recurring words are more affected than high recurring words. Some words having the same frequency are not made similar, particularly inconsistent words. Moreover regular words are sometimes pronounced irregularly. According to experts a simple dual route model cannot explain all these outcomes. A dual route model can be used for the prediction of real words though the lexican route. However we can see that steadiness, rate of recurrence and uniformity effects reaction times. The suggestion that non words are read by the GPC route is not correct. Strong findings suggest that non words processing s are affected by the lexicon. Previous normal reading process of a person is affected by the impact of acquired dyslexia the affected person will suffer some kind of a shock in the left side of his brain. They do not associate themselves. Therefore the dual route model is supported. But in other types of dyslexia the situation can be more complicated. Another type of dyslexia is the deep dyslexia. This type is characterised by poor reading of non words, semantic reading mistakes for real words, and problems associated with the GPC route. Moreover the patients under this category have an injury to a system which usually allows them to read through a semantic system. This type of dyslexia cannot be regarded as a syndrome. But in some circumstances it has to be regarded because evidences support it. Another point of argument about this type of dyslexia is that it may be a result of reading using the right hemisphere of the brain. There are assumptions that this type of dyslexia is a syndrome which is caused by a wound in the left hemisphere. If that is correct then the conclusion should be that reading is possible through semantic system in such a way that the dual route model cannot be taken into account. According to psychologist Knight R.A from his journal article titled, Language, history and use, there are alternatives to the dual route model also. They are the three routes model, Analogy theories and the Connectionist models. In the three route model, the lexical route is split into GPC route, the route through lexicon and the route direct from the lexicon. Analogy theories are single route theories. a major drawback of this theory is that it is sometimes unpredictable regarding the pronunciation of non words. The connectionist models are single route theories where there is no storage for individual words. The drawback of this model is that it also fails to predict the pronunciation of non words (Knight, Language History and Use). The dual route model has become a standard model for both normal as well as abnormal reading of adults. There is very strong evidence that there is twofold disassociation of phonological and surface dyslexia in the dual route model. The dual route model had assumptions that the conversion of grapheme-phoneme depends on a theoretical set of rules which is similar to the plans in a logical system. Other models of normal and abnormal reading development were developed on the basis of the dual route model of mature reading. The dual route theory is a very comprehensive theory. It explains both normal and abnormal adult reading and as well as normal and abnormal reading development (Pennington, 2002, p.292). In the semantic system, spoken as well as written words always turn on mechanically the matching theoretical representations. All familiar words used whether they are customary or non customary can be processed through the lexical route. This is possible in terms of their letter indicated by sound relationships. However the non lexical route makes use of the sub word level process which is based on the sound- spelling association rules success of non lexical route always depends on non words and regular words that is always associated with the English phoneme grapheme conversion laws but when there is irregular words which does not obey these set of rules, it fails to produce a correct response. All the efforts undertaken to read or write through non lexical method can result in regularization mistakes. Studies by psychologists Rapcsak, Henry and others revealed that dual route model contains purposeful mechanisms that are exclusive to both the lexical and the non lexical routes but no one can say that the two procedures are totally independent. Dual route theory always maintains that lexical route will help in delivering a true response for irregular words. The non lexical route is essential for the reading and spelling of non words correctly. For the interpretation of the written language of persons having acquired alexia / agraphia, dual route models have provided a powerful hypothetical structure. It is possible to identify the damaged cognitive module of neurological patients by specifying the practical architecture of the written language processing system. For example, the destruction that is caused to the lexical route will give rise to surface dyslexia distinguished by disproportionate complexity in reading and spelling irregular words. However damage to the non lexical route will result in phonological dyslexia, distinguished by very poor reading and spelling of non words. Apart from all these applications, dual route theory can also be used for producing quantitative predictions related to reading and spelling. It is possible to predict the accuracy of a persons and the performance on irregular words as well as non words. The basic concept of dual route models is that using lexical method irregular words can only be read correctly whereas by using non lexical strategy non words can be read correctly. The capability of lexical and non lexical routes are proved when a person will be able read accurately proportions of irregular words. According to dual route theory, both the lexical and non lexical route can process regular words and therefore the accuracy of reading can be predicted (Rapcsak, Henry, Teague, Carnahan Beeson. 2007. p.2519-2524) A study conducted by John marshal, another renowned psychologist in the year 1984 clearly emphasised that the fact that the method of skilled reading can be used, particularly the dual route model, for interpreting acquired dyslexia as well as developmental dyslexia. This claim became controversial and many other researchers argued that the dual model is quite in appropriate in the way to understand development in reading and developmental disorders in reading. However further research in this area by psychologists Castles, Bates Coltheart revealed that John Marshals claim was true (Castles, Bates Coltheart. 2006. pp. 871-892 (22)). Many researches have been undertaken for checking the effectiveness of dual route model. The dual route cognitive models of reading assume that the lexical and sub lexical routes are functionally different processes. Researchers Joubert, Beauregard and others have tested this hypothesis by using three experimental conditions. One of them was lexical and the other two were sub lexical. Frequent words represented the lexical condition whereas in the first sub lexical condition was represented by non words made of low frequency sub lexical units. These words did not resemble real words. Rare and regular words consist of the second condition. Comparisons were made between these reading tasks with a baseline condition which consisted of consonant string viewing. Moreover silent pronunciation of one or two of these consonants was also done along with this process. By analysing the results of this experiment it was found that the lexical condition which consisted of regular words generates many different peaks of activations in the border area of the left super marginal region. Whereas the other two sub lexical tasks were engaged always in the area of the left prefrontal inferior cortex (Joubert, Beauregard, Walter, Bourgouin, Beaudoin, Leroux, et al. 2004. p. 9-20). Renowned psychologists Hanley and Gard advocated that developmental surface dyslexia appears in adults. They took reading and spelling tests on two adult students and the results varied. Both these adults were affected significantly by spelling regularity. The psychologists arrived at the conclusion that the irregular words are harder to study that difficult ones, therefore a person is forced on to depend on lexical strategy during the course of reading (Funnel. 2000. P.138). The dual route models have always come under attack in recent years the theories framed by dual route experts are not always effective in adults. Most of the criticisms in the dual route model have come in the field of adult readings. As a result of criticisms levelled against dual route models, connectionists models were developed (Treiman. 1993. p.34) Studies made on languages which were opaque suggested that the lexical and non lexical processing consists of independent routes. Where as in the case of transparent languages, there is no strong evidence for independent routes. The dual route in transparent languages like in opaque languages has created an arena for discussion. By studying the neurologically damaged patients who are unable to read unknown words or non words, the existence of these routes can be seen clearly (Plasencia, Dorado Serrano. 2008. p. 48 -54). According to a study conducted by two well known psychologists, Castles and Coltheart, process deficit models of disability became popular due to the developmental problems associated with reading disability associated with brain damages. The reasons for the popularity of the process models is because of the simplicity of its framework moreover the approach of a process deficit model gives a basis for a logic of instructions stuck by the strength and weakness of the readers. But unfortunately many researches have failed to provide evidences that support process models. The fact stated in the process model that disabled readers can be categorized into distinct types and the diagnosing task of distinguishing disabled readers from the poor readers has no supportive evidence (New Directions in Research, 2006). In another experiment by Bertelson, two hypotheses were tested with relation to the development of access towards lexical meaning. They were initial indirect access and initial direct access. Conclusive proof relating to the testing pointed out that these hypotheses were not strongly supported. And it also recommended that the direct and indirect access could be used for early reading. The involvement of these procedures always changed during its course of development. The previous assumption about standard dual model was that both accesses assumed the basic theoretical tests, went wrong. Based on evidence derived from these tests, the standard dual route model was always criticised. Instead of the standard dual model, a single model was found suitable (Bertelson, 1987. p.113). The dual route cascaded model is a computational model related to visual word recognition and loud reading. It is the only computational model that is used to perform the two tasks i.e., lexical reading and aloud reading. The DRC model has its own limitations. A common claim attributed to this model is that it can explain everything. But this claim becomes false as far as the case of reading aloud and visual lexical decision is concerned. With various paradigms that are masked, facts suggest that phonological properties of very temporarily presented stimuli can influence performance in reading aloud and lexical decision tasks. The dual route cascading model or the DRC model is used for pronunciation computing from print through lexical and non lexical procedures. Non words cannot be read correctly under the lexical procedure because they are not present in the lexicons. (World Recognition Process in Reading. 2005). Many studies have been undertaken to prove the effectiveness of the dual models. In one study done by psychologists Basso, Burgio and Prandoni, of the neurological clinic, Milan University, a group consisting of 21 people were selected having specific disorders and treated with a dual route model. Another group consisting of 23 persons were treated with methods using single route models. By comparing the treated patients from both the groups, it was found that the first group treated with the dual method showed significant improvement than the second group in many areas. But the benefits received from reading of isolated words, homophones etc did not improve the reading of passages. This suggested that treatments using dual models should include exercises containing passages or sentences (Tressoldi. 2000). In another test, persons who did not have previous knowledge about French were asked to learn 12 French words. After getting their representations, they were given pictures and were asked to write the baseline. This experiment was repeated for three times. After 10 minutes these pictures were presented again and were asked to write words. After a week, these participants were again requested to do the same exercise. The results showed significant difference. The out come was that when irregular orthographic representations are acquired, it is supported by knowledge of orthographic representations (BASSO, BURGIO, PRANDONI. 1999.p.405-412). Arguments against dual route model theories. Connectionist modelling techniques have spawned the debate between single and dual route accounts of the cognitive process. The necessity of dual route processing accounts in the psychology of the language has been questioned by connectionists models. Some psychologists have also suggested that a single route model is enough for the learning of past tense formations and idiosyncratic formations which are rule based. It is also sufficient to learn rule based method of pronunciations and idiosyncratic pronunciations. Basically there are two types of criticisms that are levelled against the dual route models. The first one is that morphology is the rule which directs association of the bilinguals lexical representations. It is argued that morphology can alone produce clear effects of independence in a sole undifferentiated structure. The other side of this debate between dual and single model is that whether there is necessity to postulate one or two realistic processing mechanisms to motivate a given cognitive ability. Dual routes are not effective in all areas, particularly in the field of bilingual word recognition. To those areas where dual theories are insignificant, it is wise to work with connectionists models which are regarded as an exiting prospect. Single route models when compared with dual route models should overcome many hurdles to get accepted. However they can be used in situations where dual route models fail to produce results. The single route models always characterise stimulus response compatibility effects to the difficulty of transaction from stimulus to response whereas dual route models suggest that compatibility effects reveal in part an extra direct or routine creation route. In consistency is one of the major drawbacks suffered by these models. Form the outcomes of studies undertaken; it is evident that the DRC model can stimulate the reading aloud task as well as the lexical decision task. The stimulation given by the DRC model to these tasks cannot be matched by any other models. Therefore the DRC model is regarded as the most successful computational model discovered so far in the field of reading behaviors. Nowadays word recognition models are constructed on the basis of dual route as well as connectionist models. Dual route has its own advantages and limitations in adult reading. In cases where dual method is not effective, connectionists models can be used. Or a combined format can be used. This act of terror made the Islamic community a focal point of the media, which educated the populace on the violence of Islam or as they choose to call it Holy War. The truth is that, Islam is not the only religion that has committed violence in the name of God. Christianity also has its history of violence and Holy Wars, they were called the Crusades. There were three main reasons given for the Crusades; Rescuing fellow Christians from Invasion and persecution, Conquering or retaking lands in the possession of other religions and fulfilling personal vows to go on a crusade (The Crusades 1). Today we refer to Holy wars as Killing in Gods name, but war an d religion have gone hand in hand for centuries. People go to battle after praying and making sacrifices to God, making them believe that God is on their side because they are fighting for his cause. An example is when Joshua destroyed the Anakites in the Bible. Involving God in such violent acts is not supposed to make a war holy. Fight in the cause of Allah those who fight you but do not transgress limitsAnd slay them wherever ye catch them. And turn them out from where they have turned you out; for persecution is worse than slaughter; but fight them not at the sacred Mosque unless they (first) fight you there; but if they fight you, slay them. Such is the reward of those who reject faith. But if they cease, Allah is oft-forgiving, most Merciful. And fight them on until there is no more persecution. And the religion becomes Allahs. But if they cease, let there be no hostility except to those who practice oppression (The Quran, Surah 2:190-193). The Quran is the holy book of Islam; the above quote is from the Quran it encourages the Holy war. Partly this explains the numerous battles the Muslims were involved in few centuries ago, fortunately in modern times the Jihad is no longer carried on a large scale as compared to the past but there are still some exceptional cases. The Hadith is another important book in Islam and it is second to the Quran. The Hadith contains the recorded sayings and deeds of the Prophet Muhammad and he encourages the Jihad, saying that anyone who dies fighting for Allah will be rewarded, by going to paradise. Many of these sayings have been interpreted in different ways and people have acted according to these interpretations which have lead to brutality and wars. Although in this modern age, with the help of globalization and westernization the frequency and scale of religious wars have declined over time. However, a small percentage of Muslims, the extremists and anti -western ones still dwell on the verses in the Quran that talk about war, conflict and violence. This is what has lead to terrorism and suicide bombings in recent times. In addition, the duty of all Muslims is to do the utmost against those who do not believe in Allah, this was meant for nearest enemies of Muslims but as more Foes arose with time, the statements supporting the Jihad were updated. (Holy War 123) The Muslims are acting according to what they read in their Holy books, most do not feel remorseful for whatever damage they have caused because they believe this are divine instructions of the holy book. Today we do not hesitate to link the word Jihad which means struggle in Arabic to Terrorism, especially after the September 11 attacks. Religious wars and violence happen in some other countries like Nigeria which is one of the most religious countries in the world. In Nigeria, Muslims and Christians clash frequently, fighting and rioting over one problem or the other, but yet the opposing religions know very little about each others believes. Religious wars in Nigeria are fueled by ignorance, tribalism, poverty, politics and struggle for pow er. Another country that has experienced religious war this modern time is India; with a high population of Hindu, a small number of Muslims and a few Christians. Approximately hundred Christians were killed in a recent religious battles and another ten thousand left without a roofs over their head, telling us that religious wars may have reduced but still occurs in some societies. Furthermore, there are two forms of Jihad the greater and lesser Jihad. The phrase internal Jihad or greater Jihad refers to the efforts of a believer to live their Muslim faith as well as possible (Internal Jihad1).This definition is thus because after a battle the prophet said this We are finished with the lesser jihad; now we are starting the greater jihad. He explained to his followers that fighting against an outer enemy is the lesser jihad and fighting against ones self is the greater jihad. (Holy war) This means that the lesser Jihad will refer to the struggle against Unbelievers. Muslims set a great effort to live the way Allah instructed them, the personal Jihad has to do with the teachings while the Jihad against unbelievers is the Practical. However, some scholars find the Quran teachings of morality and encouragement of violence very contradictory. Many historians believe that the true meaning of Lesser Jihad does not necessary encourage fighting and brutality but states that Muslim should take a stand for their religion only when Islam is threatened. The misinterpretation of the lesser jihad, as a cause or reason to fight and engage in violence and brutality does not make it holy. If Islam is not threatened and Muslims wage war against non-believers then this cannot be referred to as Lesser Jihad. Over the years various people have interpreted the Quran, their interpretations were influenced by the struggles that they were experiencing at that time. Factors such as oppression, depression, anger, suffering, hunger for power, hatred and other factors have influenced the interpreters perception of the scriptures. For instance, the Taliban strict and extreme version of Islam has even made other Muslim countries view the Ta liban with suspicion. Osama Bin Laden, the leader of the terrorist group Al Qaeda has quoted the Quran on several occasions to justify their violent actions on the west. Political leaders use religion to convince and justify their selfish desires. Using religion makes their argument convincing because they twist and interpreted the scriptures to serve the purpose and believers easily embrace them and believe it is just. Al Qaeda has used suicide bombing as tactics for attacks and the Quran forbids this. (burk /Norton) By large, Christianity is a religion that preaches peace but the record of killings and destruction in the past is contradictory to its teachings. In the past, wars were fought against those who opposed Christianity; the wars were fought primarily against Muslims. This is because the rise of lslam slowed down and threatened spread of Christianity. lslam under the rule of the Umayyad Caliphate spread from what is now Saudi Arabia in the Arabian Peninsula to Spain and parts of France. (The Origins of the Crusade 1) This made lslam a treat to Christianity and the Catholic Church, which was very powerful during the medieval times. The Church had enough political backing to crush anything or anyone that disobeys or treating the beliefs of the Church. Some have argued about the religious cause of the crusades and these are some of their arguments. Some argue that they were a necessary response by Christendom to the oppression of pilgrims in Muslim-controlled Jerusalem. Others claim that it was political imperialism masked by religious piety. Furthermore, others argue that it was a social release for a society that was becoming overburdened by landless nobles. (Crusades and religious violence 1) Whatever the reason, it does not change the fact that a lot of lives and property were lost in the process. The first Crusades were organized by Pope Urban II in 1095. His main aim was to take Jerusalem from the hands of those he believed were non believers. Pope Urban II helped lay the foundation for many years of bitter and violent fighting between Christianity and other religions. The Crusades were triggered by popes at that time like Pope Urban ll and Pope Eugene III who called for the second crusade (the crusades1). The crusades were also used as a form of regaining the lost lands of Christians and getting more power for the Church. The periods of the crusades were from 1905-1291 CE. In total, there were either eight or nine Crusades, depending on your view. Most historians consider the 9th Crusade to be part of the 8th. It was not only believers of other religions that suffered persecution, some Christians also suffered. Church theologians or leaders dealt with anybody who followed another religion or come up with rational thoughts that threatened Christian beliefs an example is the case of Galileo. Galileos teachings during the 17th century threatened the geocentric view of the universe. He said that the earth revolved around the sun. The church maintained that the earth was stationary and the sun and heavenly bodies revolved around it and this was an accepted fact. Thus were Galileos claims, labeled as the ranting of a heretic and he was confronted by the church leaders and told to recant his theory or face the consequences (which generally meant death). In addition, right after the civil war in the United States, the protestant-led white supremacist Ku Klux Klan members engaged in destruction of property, cross burning, beating, arson, murder rape and whipping against Jew, Catholics and African Americans and other social ethnic minorities. These are grave crimes exhibiting extreme violence and brutality. This was pure Christian radicalism. In addition The Arm of God (AOD) is an underground Christian terrorist organization active in the United States. This gr oup has been involved in anti-abortion violence such as murder, property crimes and kidnapping. All these organization believe they are fighting for the morals of their religion and in the name of God. Consequently, religious violence has lead to religious and ethnic profiling in society. The recent terrorist attacks have found to be rooted to religion and ethnicity thus causing countries to use profiling as a context for law enforcement and counter terrorism. Profiling can be defined as the use of racial, religious or ethnic stereotypes, rather than individual behavior, as a basis for making law enforcement and investigative decisions about who has been or may be involved in criminal activity. The global generalizations about a particular ethnic or religious groups propensity to commit a crime has made life difficult for people with certain ethnicity or religion. Society begins to look at such people as potential threats and this affects their daily lives at school work and social interaction. Finally, today religion is not really considered an act of violence, Christians especially Catholics are not proud of the crusades that happened in the past. This point in history, are now looked upon as a dark period In Christianity. A group of Western Christians recently formed a body, their aim is to repair the damage caused by the crusades by apologizing to the other religions that were affected during that time. But when have Christians demonstrated this love to Muslims or Jews? We have gone to them with swords and guns. We have gone to them with racism and hatred. We have gone to them with feelings of cultural superiority and economic domination. We have gone to them with colonialism and exploitation. We have even gone to them with the Gospel cloaked in arguments of superiority. Only a few have ever gone with the message of Calvary We must do more than carry the message, we must be the message Reconciliation Walk. This kind of movement helps to show that Christians are not will ing to carry out the crusade; no recent case has been heard. Todays Christians want to practice their religion without harming anybody. The same can be said for most Muslims, although some Muslims extremists are obsessed with fighting the west. I believe Muslims and Christians can live together if only they are more welcoming and try to understand each other. In addition, if they abide by the morals and holy teaching of their scriptures then there would be some level of peace and acceptance. Violence in the name of God does not make it holy nor justify it.

Munchausen Syndrome History Munchausen Syndrome, an illness of psychiatric nature, was first introduced by Richard Asher in 1951 (Zibis et al., 2010). Although Munchausen Syndrome had been described in 1931 by Karl Menninger in medical publications it wasn’t until 1951 that Richard Asher published three case reports and the disorder gained interest (Turner, Reid 2002).The syndrome, as described by the Merck Manual for Healthcare Professionals (2008), is a severe form of a factitious disorder in which the patient tends to feign some kind of illness (physical or mental) without an external reason. Richard Asher was a renowned British endocrinologist and hematologist who is said to have named the syndrome after the fictionalized accounts of Baron Karl Friederich Munchausen (1720-1791) a German soldier who was famous for the adventurous tales about his life (Murray, 1997). Consequently because of the extensive traveling, peculiar stories and refractory treatment, as more cases appeared the syndrome took on various names such as the following: pathologic malingering, chronic factitious illness, and peregrinating problem patients (Justus, Kreutziger, Kitchens 1980). Diagnosis Patenaude, Zitsch, and Hirschi (2006) define a factitious disease as one in which the patient consciously and purposely injures themselves in order for a physician or caretaker to make a wrongful diagnosis and thus be submitted to treatment. Immersion Schools :: Teaching Public Education

Immersion Schools Immersion schools started for a number of reasons, but predominantly to include native language use in the education of language-minority students. This enabled children from other countries to learn English along with studying in their native language. Immersion integrated native English speakers and native speakers of another language (such as Spanish or French) for most of the day, with the goals of promoting academic achievement, language development and cultural understanding of other students. Immersion schools keep their populations balanced, they hold around fifty percent native English speakers and fifty percent speakers of a non-English language. The academic instruction is held in both languages, with the non-English language being used from fifty to ninety percent of the time. This way the students can be the learners and the teachers at the same time. The two-way immersion creates a bilingual environment for all students; since the first language (for example English) is maintained while the second language (for example Spanish or French) is acquired. Schools are set up to promote this bilingual language learning. Teachers are persuaded to use cooperative learning, hands-on material and visual and graphic displays to teach the content material. The schools are required to have classroom materials in both languages, and school wide materials such as library resources and computer software in both languages. They ask for support from families and the community. They make serious efforts to ensure that both languages and cultures are thought of equally, and the families are included in the school decisions. Schools face some problems with beginning the immersion program. Not many of their teachers had ever experienced this kind of language immersion when they were in school, which makes it difficult to understand how to teach these children. The schools tend to try and create a program for the teachers to attend before coming into their own classroom, but there is only so much a program can prepare that teacher for. Traditional teaching and teaching at immersion schools are dramatically different. In Immersion schools language acquisition is important along with the basic teaching skills. Although teaching the second language is the most crucial part of immersion schools, teaching the basics and making sure that the children understand is still very important. Teachers at the immersion schools have four specific teacher tasks: to make the input comprehensible, to provide opportunities for language output, to enhance the comprehensibility of readings and to develop a system for providing constructive feedback.

Cultural Background Paper Essay

The fusion of cultures has been ever growing and I would like to say- being multiracial these days is not a new phenomenon. There are many of us who come from a similar status where we share different ancestors from different cultures. For instance, my own friend has a Hispanic father and an African-American mother. Both the parents come from different cultures and the instances have been increasing. However, I share an Indian background with a Hispanic background. The fusion of the two cultures was unthinkable but I believe it has to happen sometimes that way. The main reason why I believe we have cultural fusions is because of the increased ethnic and racial diversity in the United States of America. It is interesting to note how different parents from different cultures actually bring in their stories and traditions into our lives. I believe it is easy to distinguish characteristic traits from an Indian background and a Hispanic background. There are a few traits that make one easily recognizable and distinguishable from others. Importance to family ties and bonds is extremely crucial. I remember my father (who obviously shares an Indian background, American-Indian) who stressed on the importance of relationships. Grandparents, uncles, aunts and every relative had to be respected and served on their occasional arrival. Indians are particularly fond of spicy food with their own kind of spices which includes lots of chili, cumin powder and other so-called â€Å"masalas† in their food (Gawle, 2003). There is an obligation and responsibility that the Indians exhibit in their mentality which makes them extremely family-oriented. As Jean Bacon in his book, â€Å"Life-lines: Community, Family and Assimilation among Asian Indian Immigrants† states regarding this stance, â€Å"The notion of obligation perhaps encourages members of the second generation to follow the wishes of their parents regarding issues such as educational choices or choices of marriage partners more often than would be the case if this sense of obligation were not present. It was very surprising to me that none of the children in these families ever defied his or her parents’ desires. No one ever decided to move away and become financially independent in order to pursue his or her own, as opposed to his or her parents’, desires. No one took out educational loans to secure the education of his or her choice† (Bacon, 1996). The system of joint-families and extravagant weddings with lots of food and numerous ceremonies is synonymous with them. Their music sense with the sitar and the classics by well-known singers was their favorite. Religion and spiritual obligations were also taken seriously. As Charles A. Moore in his book, â€Å"The Indian Mind: Essentials of Indian philosophy and culture† states regarding Indian culture, â€Å"It is common ground in Indian thought that the adoption of secular means and methods do not lead to freedom or salvation. It may be held that, if we could conquer Nature and fully exploit her resources, we might satisfy all our wants, and as soon as they arise. The modern man in the atomic age with his immense faith in technology is prone to think that the solution lies this way. But wants may still outstrip our ability to satisfy them; a leap-frog race may result. The root problem is left untouched. Technology cannot provide the wisdom and the good will necessary to make a wholesome use of our power. Control over Nature without control over oneself (self-restraint) can lead only to rivalry, domination, conflict, and suicidal warfare. The human problem is basically spiritual; it lies in self-control and self-education† (Moore & Morris, 1967). The following quote from the book on the Indian culture shows the immense spirituality in the Indian community and how they try to resolve their problems through the means of self-control. Their religion and their belief in spirituality play a vital role in bringing out these characteristics. My mother who is a Hispanic lady submitted to the Indian culture as they shared a few common ideologies. On the whole, the Indian trait in my family background is dominant. An interesting study was done by Shamita Das Dasgupta on the gender roles and cultural continuity in the Asian Indian Immigrant community in the United States of America where she evaluates the attitude of women and dating in the Indian culture. Her revelation is as follows, â€Å"Where attitude toward women was concerned, there seemed to be great intergenerational similarities between parents and children. The belief in gender equality of both mothers and fathers was positively correlated with that of their children regardless of age. However, mothers’ egalitarianism seemed to be mitigated by their children’s age. That is, the older their children, the more conservative mothers became regarding women’s roles. Since mothers’ own age was not linked to this relationship, it can only be speculated that as adolescents grew older, their mothers started to experience the pressures of socializing them in traditional gender roles. In the process, they themselves turned toward conservatism† (Dasgupta, 1998). Another interesting trait that can be drawn in the Indian culture is regarding the relationship between a boy and a girl. The Indian culture places an immense importance on the physical chastity. In other words, there is nothing like sex-outside-marriage for them. As Shamita Das Dasgupta in her journal article states, â€Å"Undoubtedly, a reason for instilling inhibitions about dating in girls more than boys is due to Asian Indian parents’ obsessions with maintaining sexual chastity. Dr. Prasad, a professor of engineering conducting a youth forum in New Jersey, stated, â€Å"From an Indian Culture point of view, dating involving physical relationships before marriage is not permissible. † Segal (1991) notes this fear in Asian Indian parents and believes most Indian immigrants who are not quite familiar with the practice tend to conflate dating with sexual activity† (Dasgupta, 1998). The idea of physical chastity plays an important role in the Indian community and any kind of illicit relationship outside the framework of marriage is taboo for them. It means absolute disgrace on the family if any such kind of an act is indulged by either the boy or the girl. In Hinduism particularly, such girls are exiled from the communities and their family members are disgraced and humiliated to a great extent. My parents value their own cultures and traditions. Though I come from a bi-racial background, my family has most of the Indian traditions in it as my mother had very willingly given herself to the Indian heritage. The freedom stories as well as the Indian history are still known to my father. My father stated in a brief conversation, â€Å"Indian culture imbibes its traditional roots from the Vedas. We have a deep attachment to it and we cannot forget what our country has done for us to bring us so far. Our Indian tradition and culture is our identity to who we are. Indian culture promotes an inner sense of brotherhood and unconditional love- something that I witness lacking in the West but we have a small world of our own here. I still value the Indian norms and I am proud of it as well. I cannot forget the freedom fighters that fought for our beloved country. I believe that is how we are here. I cannot forget the sacrifices given by our country’s soldiers to protect India from foreign invasion. The emotions are far too many to be forgotten†¦Ã¢â‚¬  (John K. Ram Prasad, personal communication, May 15, 2007). John Y. Fenton, in his book entitled, â€Å"Transplanting Religious Traditions: Asian Indians in America† lists some of the important characteristics that are found in the Indians and are most desired to preserve. He lists family as the most important trait and dominant in the Indian culture. Secondly, he states Indian character (pious and chastity) and thirdly, he states religion as the inherent trait amongst Indians. Fourthly, he finds cultural arts and language as important traits in the Indian culture. (Fenton, 1988). There are some hints on the Hispanic culture in my family background as well. Though they are not very dominant, they are worth looking into as the character traits are identifiable in their own way in my family. I believe the reason why it was easy for my Hispanic mother to accept the Indian traditions as her own was because they shared many similarities, one of them being their conservative or traditional lifestyle. Furthermore, the Hispanic culture also places immense emphasis on the family, religion and community (Sutherland, 1997). My father also exhibits similar characteristics as discussed above but he has evolved in some sense. As stated in several literatures above regarding religion, my father keeps his religion in his own personal space and allows his children to make their own decisions (which are very unlikely to happen in a typical Indian culture). Adapting to the American environment came easy on him and adapting to the Indian culture came easy on my mother. I have witnessed many occasions when my father gave his first priority to family and then on building a perfect human character in his children. His children and wife were always his first priority over everything and he made sure they received the best of education and lifestyle. Furthermore, his moral stories enlightened us to be good humans and be of good human character. His teachings also revolved on the aspect to respect our grandparents as well as our great-great-ancestors that he so proudly talks about. Though an American now, his Indian values are still present and he vows to pass it on in every way he can through us and though his grand children, as he says. He still celebrates all the festivals and all the Indian rituals. I have personally witnessed these traits in my family that show that my parents are indeed very knowledgeable about their culture. As we saw above, the traits of the Indians are very dominant in my family and most of them have been discussed and stated as being visible in my family. Yes- the traits have also been found visible in my close Indian relatives as well as grandparents who value their Indian culture and still prefer to eat chapattis, curry, sweets and love Indian music and ghazals (Ghazals are slow Indian songs with Urdu lyrics, sort of a beautiful poetry on subjects like love, life and sadness). Old Indian movies and soap operas still occupy a prominent status in my grandparents’ menu through which they cherish their Indian culture and the traits are obviously noticeable. As my grandmother stated a few days ago, â€Å"We cannot forget where we are from†¦ we cannot forget our land, no matter how long we have lived here. We cherish our cultures through centuries and no matter where we are, we will continue to cherish it till our death and pass it on†¦Ã¢â‚¬  (Jodha Ram Prasad, Personal Communication, May 20, 2007). Racism has been an old tale in the history of United States of America and still continues in different manners with different thinking patterns today. They label people like my parents and grandparents as â€Å"typical stereotypical characters† though they have lived all their life to this country. Personally, I have never had any racist experiences but my relatives who have been here for over three decades did. They had problems getting enrolled into American institutions and they would often be looked down as from the â€Å"third-world countries,† though they hold the American citizenship. My uncle states his story that depicted racism exhibited in his own words, â€Å"I was 18 when I had finished my high school and lived all my life in the United States. Even then, we had our house in such a locality where only immigrants lived. It was difficult for us to buy or rent houses in those locations where whites would live. Once I tried getting a house in a typical white locality and found that they gave me rates that were twice expensive than what they charged the white people. This would eventually force us to buy homes in immigrant localities, hence depicting discrimination. We were discriminated based on where we came from. We would be paid lower than the whites in our era when the fight against racism was still in its beginning stages. It was difficult to get the law in our support either. We were eventually marked as weak and powerless†¦Ã¢â‚¬  (Hardy Lewis Choudhry, Personal communication, May 21, 2007). There are many such stories that we would get to hear. These were not new then and are not new even now (though we have several legislations and agencies protecting us from racism). Our grandparents, parents and relatives have a lot more to say than anyone else as racism was extremely common when they immigrated to United States than it is now. Today, we have our rights protecting us from discrimination and racial profiling (that previously didn’t exist). Even today, as I see, Indians are marked stereotypically as foolish and old-fashioned thinking people. There are quite many things that I have learned about my family’s culture through this research and this includes the Indian philosophy and culture, including the racism stories and several other experiences from my primary care-givers. The American culture that I have blended in and the Indian culture that still persists in my family are poles apart in their philosophies and so are their lifestyles. I have witnessed that the conservative Indian thinking is actually a trait that is passed on and I have seen that the Indian culture values a person by his character. Earlier, my focus was never laid on my family’s culture as we lived the way as every American family would live but it was interesting to note the rich characteristics of Indian culture in my family, including my parents, grandparents as well as relatives who gave a tremendous insight into several notions of the Indian philosophy and Indian traditional values. I believe and I respect the traditional cultural values of my family (earlier to which I was not exposed to) and I have learned how spirituality plays a vital role in the making of a person’s character and mind. On the whole, the experience has been quite enriching as India is truly a country with diverse cultures and an interesting history.
